Lawsuits and Subpoenas
Service of Summonses and Complaints
MSU is the State of Montana acting in its higher education capacity. MSU may be served only at MSU’s Office of Legal Counsel. The Office of Legal Counsel is authorized to accept service of process on behalf of MSU or the President by either personal service or mail service by notice and acknowledgement of receipt in state court actions or waiver of service in federal court actions.
Other than the parties listed above, all other individuals associated with MSU must be served wherever they are located as provided by the appropriate statute.
Service of Subpoenas
A subpoena for the personal appearance of an MSU witness must be served on that witness as provided by the appropriate statute.
A subpoena for MSU business records must be personally served on the custodian of records wherever the records are located within the MSU or the Office of Legal Counsel
I received a subpoena or lawsuit at work, what do I do?
If you happen to receive a lawsuit or subpoena that is related to the scope of your employment please forward it to the Office of Legal Counsel. If you question if it should come to OLC, please send it anyways.
