Dying Without a Will in Montana
Single, No Living Children, No Living Grandchildren, No Living Great-Grandchildren, No Living Parents, No Living Siblings, No Living Nieces and Nephews, No Living Grandparents, Situation #6 Example
Example
Survivors are descendants of maternal and paternal grandparents.
Assume you pass away without a written will. Your only survivors are the descendants of your maternal grandparents and descendants of your paternal grandparents.
One half passes to your paternal descendants by right of representation. The other half passes to your maternal descendants by right of representation. Right of representation means descendants inherit the share their parent would have received if he or she had survived you.
If this is not the division you desire, then you need to write a will.
