Dying Without a Will in Montana
Single, Living Children, Living Grandchildren from Living Children, No Living Grandchildren from Child Who Passed Away, Situation #4 Example
Example
Survivors are children and grandchildren
Assume you pass away without a written will.
You have three living children and six living grandchildren. Your assets are divided equally among your three children; 1/3 to each child.
Your six grandchildren do not inherit any assets because Montana law gives priority to your living children.
If this is not the division you desire, then you need to write a will.
