Family Allowance
In addition to the benefits of homestead allowance and exempt property, the surviving spouse and minor children whom the decedent was obligated to support, and children who were in fact being supported by him or her, are entitled to a reasonable family allowance in cash from the estate for their maintenance during the period of probate administration.
The personal representative may determine the family allowance in a lump sum not to exceed a $27,000 lump sum or periodic installments of $2,250 per month for one year. The district court may approve a larger sum.
